Prize draw terms
1. The promoter
We are Club Oenologique of 210 Canalot Studios, 222 Kensal Road, London, W10 5BN. UK.
2. The competition
2.1 The title of the competition is Club Oenologique/Torres Wine Giveaway April 2020.
3. How to enter
3.1 The competition will run from 09:00 GMT on Sunday 12 April 2020 (the “Opening Time“) to 09:00 GMT on Thursday 16 April 2020 (the “Closing Time”) inclusive.
3.2 All competition entries received after the Closing Time are automatically disqualified.
3.3 To enter the competition you must, on your Twitter account, before the Closing Time:
(a) Post a photo on Twitter of yourself, telling us what your drinking;
(b) Tag a friend in the post, asking them to do the same;
(c) Include the hashtag #SociableDistancingClub; and
(d) follow our Twitter page @cluboenologique.
3.4 No purchase is necessary however you will need an internet connection and a valid Twitter account to enter. No refund may be claimed for expenses incurred in participating in the competition, including in relation to the use of the internet.
3.5 We will not accept responsibility for competition entries that are not received by us and/or completed, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind (including any social network downtime).
3.6 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

3.9 The competition winners will be selected (electronically) at random from all competition entries which fulfill the entry and eligibility criteria.
3.10 Any entry that is deemed by us (in our sole discretion) to be unlawful, obscene, vulgar, pornographic, hateful, discriminatory, offensive, infringing or otherwise inappropriate or may adversely affect our brand or reputation will be excluded from the prize draw and we may take such other action in respect of such entry as we deem appropriate.
3.11 You must comply with the rules applicable to the social media platform in force from time to time.
4.1 The competition is open to all residents in the UK, except:
(a) our employees or the employees of our holding or subsidiary companies;
(b) employees of our agents or suppliers or their holding or subsidiary companies, who are professionally connected with the competition or its administration; or
(c) members of the immediate families or households of (a) and (b) above.
4.2 In entering the competition, you confirm that you are eligible to do so and eligible to claim the prize. Where there are any age restrictions on the prize (e.g. alcohol) we will require you to provide proof that you are eligible to enter the competition to our satisfaction before sending the prize to you. What constitutes adequate identification will be determined by us in our sole discretion but this will generally require you to provide a copy of a valid driving licence or passport to confirm your identity and age which we can verify against your social media profile or some other means. You must provide all reasonable co-operation to us to assist us with such verification, failure to do so within a reasonable period may result in you forfeiting your win and being disqualified from the competition.
4.3 We will not accept competition entries that are:
(a) automatically generated by computer;
(b) completed by third parties or in bulk; or
4.4 There is a limit of one entry per person and per social media account. Entries on behalf of another person will not be accepted and joint submissions are not allowed. You should not enter from any social media account that does not belong to you.
4.5 We reserve all rights to disqualify you if, in our opinion, your conduct is contrary to the spirit or intention of the prize competition.
5. The prize
5.1 The prize is a case of 12 Torres wines (including 3 Sangre de Toro, 3 Vina Esmeralda, 2 Purgatori, 2 Sons de Prades, 1 MLP, 1 Milmanda or Fransola), and one (1) is available to be won. Please note that images of the prize are for demonstration purposes only and we provide no warranty that the prize shall be as shown in any image.
5.2 Prizes are subject to availability. There is no cash alternative for the prize.
5.3 The prize is not negotiable or transferable.
5.4 The prize is for personal consumption only and shall not be sold, auctioned, given away or otherwise commercialised in any other way.
6.1 Our decision in respect of the winners is final and no correspondence or discussion will be entered into.
6.2 We will contact the winners as soon as practicable after the Closing Time (Thursday 16 April 2020), by direct message through Twitter.
6.3 After the Announcement Date, we will seek confirmation from the winners as to whether they consent to their name and social media handles being used in a winners announcement.
6.4 If such consent is granted and in our opinion it is appropriate to do so, we may announce the names of the winners on our social media page and/or website after the Announcement Date. We may also provide such details to any person who requests such information for a valid purpose.
7. Claiming the prize
7.1 Once contacted by us, winners must provide a valid email address within one (1) week of being contacted. We will then email the winners, using the email address provided to obtain any necessary identification, and a UK postal address to confirm eligibility criteria as set out in Clause 4.2. The winners must be able to satisfy the eligibility criteria within one (1) week of it being requested. Once received, we will email the winners to confirm eligibility.
7.2 We reserve the right to offer the prize to the next eligible entrant selected (randomly) from the remaining eligible entries if a winner does not meet the eligibility criteria or provide evidence of this within the required timescales.
7.3 Please allow at least four (4) weeks from the confirmation of eligibility for delivery of the prize. The prize will be delivered to the UK postal address confirmed as part of our eligibility checks.
7.4 The prize may not be claimed by a third party on your behalf.
7.5 We will make all reasonable efforts to contact the winners. If a winner cannot be contacted or is not available, or has not responded to us within seven (7) days of the Announcement Date, we reserve the right to offer the prize to the next eligible entrant selected from the eligible entries that were received before the Closing Time.
7.6 We do not accept any responsibility if you are not able to take up the prize.
7.7 We do not accept any responsibility for any prize being lost, damaged or delayed in the post.
8. Limitation of liability
Insofar as is permitted by law, we will not in any circumstances be responsible or liable to compensate the winners or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by our negligence. Your statutory rights are not affected.
9. Data protection and publicity
9.3 Your personal data (namely, your social media handle) will remain on our social media account indefinitely. If we do receive your email address, postal address and identification documentation, we will retain this for at least six months following the announcement of the winner of the competition. Copies of any verification documents will be destroyed after they have been received and verified by us.
10.1 If there is any reason to believe that there has been a breach of these terms and conditions, we may, at our sole discretion, reserve the right to exclude you from participating in the competition (and any future competitions).
10.2 We reserve the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
10.3 If any provision of these terms is found by any court or other competent authority to be invalid, unenforceable or illegal, the other provisions shall remain in force.
10.4 No failure or delay by a party to exercise any right or remedy provided under these terms or by law shall constitute a waiver of that or any other right or remedy, nor shall it prevent or restrict the further exercise of that or any other right or remedy.
10.5 These terms and conditions shall be governed by English law, and the parties submit to the non-exclusive jurisdiction of the courts of England and Wales.
